課程概述 |
羅爾斯的政治哲學對當代自由主義、分配正義理論、民主理論、法律與社會議題研究，產生廣泛且深遠的影響。他的正義理論發展可分為三個時期。前期以1971年的《正義論》(A Theory of Justice)為代表，他從批判效益主義出發，進而建構自己的社會正義理論「作為公平的正義」(justice as fairness)。中期以《正義論》之後發表的一系列論文和1993年的《政治自由主義》(Political Liberalism)為代表，他澄清並修正自己的理論，提出交疊共識(overlapping consensus)和公共理性(public reason)的概念。後期則以《政治自由主義》之後發表的論文和1999年的《萬民法》(The Law of People)為代表，除了修正公共理性的概念，他還提出適用於國際社會的正義理論。
本課程將閱讀與評析羅爾斯政治哲學的幾個重要觀點，首先是原初立場(original position)的理論設計，其次則是其社會正義理論的三個主要概念，包括：對的優先性(the priority of right)、交疊共識和公共理性。最後，我們將探討羅爾斯的國際正義理論。

課程目標 |
本課程欲透過閱讀羅爾斯著作原典及評論文獻，帶領學生瞭解他的政治哲學理論、相關批判及其理論對當代哲學的影響。此外，本課程將透過課堂討論、口頭報告與個人學期報告之撰寫，提昇學生的表達、論證建構與學術研究之能力。 |

課程要求 |
1.課堂報告與討論：本課程以討論為主，每週由一位學生口頭報告該週指定閱讀文本之要點，所有學生共同討論相關理論主張之合理性，並提出詮釋與批判。[說明]：若因防疫規定無法進行課堂教學，則以U Meeting進行同步線上討論。
2.課前閱讀與提問：須仔細閱讀該週指定閱讀文本內容，充分掌握問題意識與理論主張，並提出疑問和批判。
3.撰寫期末報告：須針對本課程之授課內容，自選研究主題，撰寫學術性論文。

每位學生選擇兩週主題，做口頭報告。報告者須提供紙本綱要（3頁以內）。報告與紙本綱要的內容包括：(1)要旨與論證：本文的核心問題意識和論證結構為何？作者提出哪些論點？他給出哪些理由來支持這些論點？(2)對論證的評估與批判：你認為作者的論點是否合理？嘗試提出詮釋、挑戰和回應。(3)疑惑不解之處：有哪些概念或論證不清楚或不瞭解？(4)值得進一步討論的延伸問題：相關理論或應用層面的延伸問題。 |
